Terms of Service

Welcome to GenderFlip. By creating an account or using our AI image transformation service at genderflip.org, you agree to these Terms of Service and our Acceptable Use Policy.

1. Acceptance of Terms

You must be legally able to enter into these Terms. If you do not agree to them, the Privacy Policy, and the Acceptable Use Policy, do not use the Service.

2. Service Description and AI Disclosure

GenderFlip transforms user-supplied images using third-party AI services delivered through FAL. Current options include Nano Banana for standard transformations and GPT Image 2 for HD transformations. AI output can be inaccurate or unexpected and must not be treated as authentic evidence. Models and providers may change; the current choice is disclosed in the product interface.

3. User Accounts

• Account Creation: You must provide accurate information and use your own account
• Account Security: You are responsible for maintaining the confidentiality of your credentials
• Age Requirement: You must be at least 18 years old to create an account or use the Service
• Account Termination: You may request account closure; we may suspend or terminate accounts that violate these Terms or our Acceptable Use Policy

4. Acceptable Use

You must follow our Acceptable Use Policy. In particular, you must not:

• Upload an image unless it is your own or the depicted adult expressly authorized this use
• Create sexual or pornographic content, nudity, or non-consensual intimate imagery
• Create any content involving or sexualizing minors
• Create graphic violence, hateful content, harassment, self-harm encouragement, terrorism, or credible threats
• Create deceptive deepfakes, impersonation, fraud, identity abuse, or political manipulation
• Infringe copyright, trademark, privacy, publicity, or other rights
• Evade safety checks, payment controls, rate limits, or security features

5. Content Ownership and Rights

Your Content: You retain your rights in images you upload. You grant us and our service providers a limited license to host, transmit, process, moderate, and store them only as needed to operate, secure, and support the Service.

Generated Images: As between you and GenderFlip, and to the extent permitted by law, we assign to you any rights we may have in your generated output. This does not grant rights in another person's likeness, third-party characters, trademarks, or copyrighted material.

Our Intellectual Property: GenderFlip owns its website, software, design, branding, and platform materials. Third-party AI models remain the property of their respective providers.

6. Payments, One-Time Credits, and Refunds

• Pricing: The amount, currency, included credits, and applicable taxes are shown before checkout
• Payment Processing: Payments are handled by the third-party processor displayed at checkout, which may include Waffo Pancake, Creem, or Stripe. We do not store full card details
• Billing Model: GenderFlip currently sells one-time credit packs. We do not currently offer recurring subscriptions, automatic renewal, or automatic credit top-ups
• Credits: Purchased one-time credits do not expire unless required by law or clearly stated otherwise at checkout; promotional credits may have separate terms
• Seven-Day Refund for Unused Credit Packs: You may request a full refund within 7 calendar days after purchase if none of the credits from that purchase have been used
• Non-Refundable Uses: Once any credit from a purchased pack has been consumed, that pack is not eligible for a voluntary refund. Dissatisfaction with the style or subjective quality of a successfully delivered AI result is not a refund basis
• Billing Errors: Duplicate or incorrect charges are eligible for correction or a full refund after verification
• Failed or Blocked Generations: When a generation fails before a usable result is delivered or is blocked by a required safety control, the generation credit is restored automatically. This credit restoration is separate from a payment refund
• How to Request a Refund: Use the contact form at genderflip.org/contact (choose “Refund or billing”) with your account email within the applicable period and include the order or transaction ID and the reason for the request. Approved refunds are returned to the original payment method; processing time depends on the payment provider
• Refunded Orders: A successful payment refund removes all unused credits granted by that order
• Statutory Rights: Nothing in this policy limits refund, withdrawal, or other consumer rights that cannot be excluded under applicable law

7. Privacy and Data Protection

Our Privacy Policy explains how we collect, use, retain, and share information, including uploaded images and safety-review records.

8. Disclaimer of Warranties

THE SERVICE AND AI OUTPUT ARE PROVIDED "AS IS" AND "AS AVAILABLE" TO THE EXTENT PERMITTED BY LAW. WE DO NOT GUARANTEE THAT OUTPUT WILL BE ACCURATE, SUITABLE, UNIQUE, OR FREE OF THIRD-PARTY CLAIMS.

9. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, GENDERFLIP WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM USE OF THE SERVICE. RIGHTS THAT CANNOT LEGALLY BE LIMITED REMAIN UNAFFECTED.

10. Changes to Terms

We may update these Terms. We will post the new date and provide additional notice when required by law. Changes do not retroactively alter completed purchases.

11. Suspension and Termination

We may restrict, suspend, or terminate access when reasonably necessary to address policy violations, fraud, security risk, legal obligations, or service discontinuation. You may contact support to appeal a safety enforcement decision.

12. Governing Law and Consumer Rights

These Terms are governed by the laws applicable to the GenderFlip operator, without removing mandatory rights available to you under the laws of your residence. Any dispute process required by applicable law remains available.
